The legislation practice of The Regulation on Preventing the Harms Caused by Second-hand Tobacco Smoke in Harbin

Abstract: The Regulation on Preventing the Harms Caused by Second-hand Tobacco Smoke in Harbin has been implemented since May 31st, 2012, which was the local tobacco control laws and regulations that most conformed to World Health Organization Framework Convention on Tobacco Control (WHO FCTC) in our country at that time and has played an important role of demonstration and promotion in tobacco control legislation in the whole country and other cities. The paper explores the successful practical experience of the regulations legislation from multi-sectoral cooperation and social mobilization. The pointcut of the regulations’ title is preventing hazards of se-condhand tobacco and smoke, taking total protection as principle, emphasizing the public’s right of health and avoiding the direct conflict and contradiction brought from tobacco control and smoke prevention effectively. The paper focuses on introducing the advancement of the regulations from the design of law enforcement principles, law enforcement concept, law enforcement mode and law enforcement methods, and discusses the strategies of tobacco control legislation and issues need to be addressed.
