Sketch of tobacco control legislation and enforcement process in Guangzhou

Abstract: The Article 8 of the World Health Organization Framework Convention on Tobacco Control (hereinafter referred to as the Convention) provides that governments must legislate to prevent the public from exposure to tobacco smoke. By the end of 2010, there have been 31 countries worldwide banning on smoking in work places, public places and public transport through the way of legislation. The practice of these countries proves that legislation is the only way for tobacco control.Implementation legislation on tobacco control is the responsibility of all le-vels of the governments from parties to the Convention. The standing committee of the Guangzhou Municipal People’s Congress and the government attach great importance to tobacco control legislation, and believe it is the legal weapon in tobacco control work. Thirteen deputies to the National People’s Congress put forward the draft of The Tobacco Control Regulations in Guangzhou (hereinafter referred to as the Regulation) during the two sessions in 2009. Municipal People’s Congress started the legislative process soon and passed the Regulation smoothly. The formal implementation was approved on Sep 1st 2010 by the standing committee of Provincial People’s Congress. At present, the Regulation plays a positive role on tobacco control.
